Heirs’ Property

Heirs' property is a legal term that describes what happens when a property has passed to

family members by inheritance but has not gone through probate to determine who legally

owns the property. This is often referred to as passing away intestate. When a property

owner dies, and the title to the property does not already reflect the new owners through

estate planning or is not quickly changed through probate in court, it creates what is called a

cloudy title.
